1. Acceptance of Terms and Scope

These Terms of Service ("Terms") govern your access to and use of the website located at https://sepetbayim.com and any related services (together, the "Service") provided by Sepetbayım, Türkiye ("Sepetbayım", "we", "us" or "our").

By accessing or using the Service in any way, you:

• acknowledge that you have read and understood these Terms,
• agree to be legally bound by them, and
• agree to comply with all applicable laws and regulations in your jurisdiction.

If you do not agree to these Terms, you must not use the Service.

These Terms apply to all visitors and users worldwide. Certain sections (for example, those relating to data protection) refer to specific laws that may apply depending on your place of residence, such as:

• Türkiye: Law No. 6698 on the Protection of Personal Data (KVKK) and decisions of the Kişisel Verileri Koruma Kurumu (KVKK Board),
• European Union / EEA / United Kingdom: the General Data Protection Regulation (GDPR) and the UK GDPR,
• California (USA): the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA).

2. Description of the Service

Sepetbayım operates a 100% free, advertising-funded social media tools platform. The Service allows you to:

• paste a public profile or post link from social media platforms such as Instagram, TikTok, Twitter/X, YouTube and similar services, and
• receive a trial quantity of followers, likes, views, retweets or similar engagement metrics for that public profile or post.

Key features and limitations:

• Free tools only: The Service is provided at no monetary cost to you. We do not offer paid plans, subscriptions or upgrades.
• Ad-funded model: Our revenue is generated solely through advertising (including Google AdSense). We do not charge users.
• Upstream SMM API partner: Orders are fulfilled via an upstream social media marketing (SMM) API partner (currently daosmm.com). We do not control their internal processes, timelines or technical performance.
• Rate limits: Each tool may be used only once per 24 hours per user/device. This helps prevent abuse and ensure fair access to our ad-funded quota.
• No login: We do not request or require you to create an account or log in, and we will never ask for your social media passwords or direct access credentials.

The Service is provided "as is" and "as available" and is intended only for lawful uses related to profiles and content you own or are authorized to manage.

3. Eligibility and User Capacity

By using the Service, you represent and warrant that:

1. You have full legal capacity to enter into a binding agreement in your jurisdiction (generally the age of majority, which is typically 18).
2. If you are resident in the EU/EEA or the UK and our processing of your personal data relies on your consent, you are at least 16 years old (or such higher age as may be required in your member state or region).
3. You are not prohibited from using the Service under any applicable law, regulation, or platform policy.

If you use the Service on behalf of a business, organization, or another person, you represent that you have authority to bind that entity or individual, and "you" in these Terms includes that entity or individual.

4. User Obligations and Acceptable Use

When using the Service, you agree to comply with the following obligations:

4.1 Authorization and Ownership

• You will only submit orders for social media accounts, profiles, pages or content that you own or are duly authorized to manage.
• You will not use the Service to interfere with, damage, or gain unauthorized access to any account belonging to others.

4.2 Public Profiles Only

• You may use the Service only for public/unlocked profiles or posts.
• You must not attempt to circumvent platform privacy settings or access restrictions using the Service.

4.3 No Circumvention of Technical Limits

You must not:

• attempt to bypass our rate limits (including by using VPNs, proxies, multiple devices, or similar techniques to disguise usage),
• use automated tools, scripts, bots or scraping technologies to access the Service,
• perform or attempt any denial-of-service (DoS/DDoS) attack or other actions that could impair the operation or security of the Service, our infrastructure, or our partners.

4.4 Prohibited Content

You must not use the Service in relation to any content that:

• is illegal, harmful, or promotes illegal activities,
• is hateful, racist, discriminatory, or incites violence or harassment,
• involves sexual exploitation or abuse of children (CSAM) or any other form of exploitation,
• infringes third-party intellectual property or privacy rights,
• violates the terms and policies of the relevant social media platform.

We may suspend or permanently block your access to the Service, and may cooperate with competent authorities, if we become aware of suspected unlawful use.

5. Free Service; No Payments and No Refunds

Sepetbayım is a free-of-charge Service:

• We do not ask for or process payment details.
• We do not sell subscriptions, credits or paid packages.
• Any site or person claiming to represent Sepetbayım and requesting payment or social media passwords is not authorized by us.

Because we do not accept payments from you:

• there are no refunds, and
• we have no payment-related obligations to you.

You are solely responsible for any costs associated with your own internet access, devices and data plans.

6. No Warranty; Delivery Not Guaranteed

The Service is provided "as is" and "as available", without any warranties or guarantees of any kind, whether express or implied. Without limiting the foregoing:

• We do not guarantee that any particular number of followers, likes, views or other metrics will be delivered for any order.
• We do not guarantee delivery timeframes; orders may be delayed, partially fulfilled or not fulfilled due to upstream constraints, social platform limitations or technical issues.
• We do not guarantee continuity, uptime, or error-free operation of the Service or the underlying SMM API partner.
• We do not offer refills or replenishment for free orders, even if engagement later decreases ("drops") due to platform actions, algorithm changes or removal of inauthentic activity by the relevant social media platform.
• Social media platforms may independently remove, filter or discount any metrics they consider invalid or non-compliant with their policies.

To the fullest extent permitted by applicable law, we disclaim all warranties, whether statutory, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Third-Party Platforms and Intellectual Property

7.1 Platform Terms of Service

Your use of social media platforms (including but not limited to Instagram, TikTok, Twitter/X and YouTube) remains subject to their respective terms of service, community guidelines, and policies. You are solely responsible for understanding and complying with those terms.

You agree that you will not use Sepetbayım in any way that violates or attempts to circumvent:

• Instagram’s, TikTok’s, Twitter/X’s, or YouTube’s terms, policies or technical restrictions, or
• any applicable laws or regulations.

7.2 No Affiliation or Endorsement

Sepetbayım is not affiliated with, endorsed by, or sponsored by Instagram, TikTok, Twitter/X, YouTube, Google or any other social media platform referenced on the Service. All platform names, logos and trademarks are the property of their respective owners.

7.3 Your Content and Rights

By submitting a public profile or post link to the Service, you confirm that:

• you have all rights and permissions necessary to use the Service in relation to that content, and
• our use of that link (including transmission to our SMM API partner for order fulfillment) will not infringe the rights of any third party.

We do not claim ownership of your content. However, you grant us and our partners a limited, non-exclusive, worldwide, royalty-free license to process and transmit submitted links solely to operate and provide the Service.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Sepetbayım and its owners, officers, employees, partners and service providers shall not be liable for:

• any indirect, incidental, special, punitive or consequential damages, or
• any loss of profits, revenue, data, goodwill or business opportunities,

arising out of or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Without limiting the foregoing, Sepetbayım shall not be liable for:

• any restrictions, shadow bans, reach limitations, suspensions or permanent bans applied by any social media platform to your account or content,
• any removal, discounting or filtering of followers, likes, views or other metrics by social media platforms,
• any actions or omissions of our upstream SMM API partner or other third-party providers, or
• any security incidents, outages or failures beyond our reasonable control.

Where liability cannot be excluded under mandatory law, our total aggregate liability arising from or relating to the Service shall, to the extent permitted, be limited to the equivalent of zero (0) monetary units, as no payment is made for the Service.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in such cases, the above exclusions and limitations shall apply to the fullest extent permitted by the laws of your jurisdiction.

9. Indemnification

You agree to indemnify, defend and hold harmless Sepetbayım and its owners, officers, employees, partners and service providers from and against any and all claims, demands, actions, liabilities, damages, losses, costs and expenses (including reasonable attorneys’ fees) arising out of or relating to:

• your use or misuse of the Service,
• your violation of these Terms,
• your violation of any law or regulation, or
• your infringement or alleged infringement of any third-party rights, including intellectual property, privacy or personality rights.

We reserve the right, at your expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification, and you agree to cooperate with our defense of such claims.

10. Modifications to the Service and to These Terms

We may, at any time and without liability to you:

• modify, suspend or discontinue any part or all of the Service, and/or
• modify these Terms.

Changes to these Terms become effective when they are posted on this page at https://sepetbayim.com/en/terms (or a successor URL). We are not required to provide prior, separate or personal notice of changes.

Your continued use of the Service after the updated Terms have been posted constitutes your acceptance of the revised Terms. If you do not agree with any changes, you must stop using the Service.

The "Updated" date at the top of this page reflects the latest revision date (September 21, 2026).

11. Governing Law and Jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or with the Service, shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict-of-law rules.

Subject to any mandatory provisions of consumer-protection law that apply in your country of residence, any dispute arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.

If you are a consumer, you may have additional rights under the mandatory laws of your place of habitual residence, and nothing in these Terms is intended to limit such rights.
